POSITION TITLE: Special Education - Out of District Administrator

SUPERVISOR: Director of Special Education

QUALIFICATIONS:

Minimum of 5 years experience in special education with significant responsibility for compliance and fiscal oversight.

Master's degree in Special Education, Educational Leadership, or a related field is required.

Valid New Hampshire certification in Special Education and Special Education Administration.

SUMMARY:

The Special Education Out-of-District Administrator is responsible for ensuring full legal compliance and fiscal oversight of all out-of-district special education placements in accordance with NH RSA 186-C, NH Code of Administrative Rules Ed 1100, IDEA, and district/SAU policies. This position safeguards the district's obligation to provide a Free Appropriate Public Education (FAPE) while ensuring placements are legally defensible, fiscally sound, properly documented, and audit-ready. The administrator serves as the district's primary authority on out-of-district placement compliance, contracts, tuition, and cost management.

This position will involve LEA, consultation, planning, budgeting, and personnel management responsibilities, with an increased focus on compliance, monitoring, and program quality for PK-12 out-of-district students.

The Out of District Special Education Administrator assists the Director of Special Education in the areas of program level administration, budget development, and the effective management of special education resources. The position is responsible for ensuring compliance with established special education policies, procedures, and/or regulations, understanding and disseminating information on the instructional needs of ConVal's special education students, and the monitoring of data to make informed decisions for out-of-district students.

DUTIES AND RESPONSIBILITIES:

Legal Compliance and Regulatory Oversight

Ensures all out-of-district placements (to include 402 Court placements) comply with RSA 186-C, IDEA, and NHED guidance.

Verify that placements meet Least Restrictive Environment (LRE) requirements and are supported by appropriate evaluations and IEP team determinations.

Ensure all required procedural safeguards, written prior notice, and placement documentation are properly (to include timely) issued and maintained.

Monitor and enforce timelines for evaluations, reevaluations, annual IEP reviews, and placement reviews.

Prepare documentation and collaborate with legal counsel and the Director of Special Education regarding state complaints, mediations, and due process hearings related to out-of-district placements.

Facilitates effective transitions for students to and from out-of district programs.

Collaborates with and consults with out-of-district staff to meet student needs.

Assists the Director of Special Education in coordinating and securing placements for out-of-district students placed by the District.

Oversee, monitor, and case manage all identified District students who attend Public Charter Schools.

Oversee, monitor, and case manage all identified students attending private schools within the jurisdiction of the ConVal School District.

Fiscal Oversight and Budget Management

Oversee and monitor all tuition, transportation, related services, and residential costs for out-of-district placements in collaboration with the Director of Special Education.

Review and track contracts, service agreements, and tuition rates in collaboration with the Director of Special Education for compliance with District policy and NHED requirements.

Develop, monitor, and report on out-of-district placement budgets, including projections and variance analysis in collaboration with the Director of Special Education.

Program Quality Control

Monitors all processes of identifying educationally disabled students specific to NHSEIS (New Hampshire Special Education Information System) and the special education process.

May be required to observe and evaluate staff performance, in either a primary or collaborative role.

Assists the Director of Special Education in developing and facilitating appropriate professional development opportunities for special education staff.

Ensure all out-of-district providers are appropriately approved and contracted.

Monitor provider performance and compliance with contract terms and IEP service delivery.

Address contract non-compliance, billing discrepancies, or service concerns promptly with the Director of Special Education and Special Education Administrative Assistant.

Liaison: Acts as a primary liaison between the district and the NH Department of Education, court systems, and community agencies.

Other Duties

Assists with other job-related responsibilities as assigned by the Director of Special Education.
